MONETIZE MOBILE™ PRIVACY POLICY

Monetize Mobile, LLC (“Monetize Mobile,” “we,” or “us”) operates the Monetize Mobile™ service that includes the provision of interactive mobile entertainment content, such as quizzes, trivia, astrology, quizzes, and text alerts available via SMS text messaging. This privacy policy (“Privacy Policy”) sets forth the privacy practices associated with any of our services (throughout this Privacy Policy, we will use the term “Service” or “Services” to refer to any/all of the mobile content delivery services provided, owned, and operated by Monetize Mobile™) and covers our treatment or personal information that we collect when you: (a) visit the any websites owned and/or operated by Monetize Mobile™, as well as any co-branded versions of such websites; (b) register for the Service; (c) interact with any of our Services; and/or (d) submit any other material to us.

Any personal information that you submit to us remains your property. However, we may use this personal information to administer the Service, as described herein. By subscribing to and/or using the Service, you agree to be bound by the terms set forth in this Privacy Policy including, without limitation, those pertaining to the use of your personal information. Please be sure to read this Privacy Policy carefully before accessing, registering for, or using any of our Services. If you do not agree with the terms of this Privacy Policy, please do not use or access the Service.

We reserve the right to change or remove portions of our Privacy Policy at any time without prior notification. Please check back frequently to apprise yourself of any changes that may affect you. YOU MUST CHECK BACK FREQUENTLY TO ENSURE THAT YOU SEE A CURRENT VERSION OF THE PRIVACY POLICY.

Information We Collect From You

In order to use some of the features of the Service, you may need to create a user account which requires you to provide us with personal information. You may create a user account when you first begin use of the Service or when you first place an order through the Service.

When you register with Monetize Mobile™ you may be required to establish a password-protected personal account. During the account creation process and/or to place an order, we may require that you provide your mobile telephone number, your first and last name, your mailing address, your date of birth, and a valid email address (“Personally Identifiable Information”). We may also periodically request additional optional Personally Identifiable Information, such as additional contact and billing information, or other information about you. The Personally Identifiable Information that you provide us may be given through websites or through messages you send to us from your cell phone. In all cases, your Personally Identifiable Information will be covered by this Privacy Policy. We use your Personally Identifiable Information to provide you with our Service and to contact you with regard to products and/or services in which you have expressed an interest. If you elect to register for the Service, you may receive mobile entertainment content that may include unrelated third party advertisements. We may also provide you with features that require specific information to be provided in order to use that feature. For example, we may offer you the ability to sign-up to receive newsletters or other alerts to be sent to your email address or cell phone and would ask for that contact information to deliver you the service you requested. We may also receive information about you from other sources and add it to the information you provided to us.

We may offer our users the ability to upload their own information or content to create a personalized web page for other users to see via the Service or as part of other features of the Service. By posting any personal information on or through the Service, you understand and agree that the personal information may be publicly viewable by users of the Service and that we may use it in accordance with this Privacy Policy.

Text Messages and Other Communications

By providing your mobile telephone number, you expressly consent to receive a registration text message from us. In most circumstances, the text message that you receive in connection with the registration process will contain a personal identification number which is used to set-up your account. If your particular wireless carrier does not support our Service, or you do not complete the registration process in full, you expressly consent to receive a promotional text message from us. By registering for our Service, you expressly consent to receive communications, which may include advertising content, from us periodically via text message or email. You can opt-out from receiving any further promotional text messages by replying via text message with the word “STOP” or by following the opt-out instructions in the email.

We may send you service-related announcements when it is necessary to do so. This may include text message reminders that your membership is being renewed. Should you cancel your membership, we may send you a confirmatory text message or an email.

Cookies, Pixel Tags, and Log Files

“Cookies” are small pieces of information that are stored by your web browser software on your computer. We use cookies to recognize you and personalize your viewing experience on the website, track website usage and traffic patterns, and to estimate our website traffic. Although most web browsers are initially set-up to accept cookies, if you prefer, you can decline the placement of a cookie on your hard drive by using the appropriate features of your web browser software, if available, to delete the cookie. Please note that certain areas of the website may not function properly if your web browser does not accept cookies.

A “pixel tag” is an invisible tag consisting of a few lines of computer coding placed on certain pages of websites you visit. We may use “pixel tags” to conduct “pixel tracking.” Pixel tracking uses pixel tags to track an individual user’s Internet activity in connection with online advertisement. Pixel tracking measures the effectiveness of these advertisements and compiles aggregate and specific usage statistics. This data is collected for use in our marketing and research. Personally Identifiable Information about you is not collected by us in connection with pixel tracking.

We may also collect information when you visit the website through clear gifs and other means such as your Internet protocol (“IP”) address, browser type, Internet service provider (“ISP”), referring/exit pages, platform type, operating system, date/time stamp, and clickstream data. This information is an important tool that we use in evaluating and improving the Service to make it more fun and useful for our users.

When you create a Monetize Mobile™ account, we keep track of how you use the Service and your interactions with us, including but not limited to your website activity, order history, payment history, and correspondence. In addition, we use log files to keep track of information and to improve the Service.

Can Children Use the Service?

We encourage parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children. We will never knowingly solicit or collect information from individuals under the age of thirteen (13). If we determine that we have inadvertently collected Personally Identifiable Information from someone under thirteen (13) years of age, we will take reasonable steps to purge this information from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties.

The Service is not for use by individuals under thirteen (13) years of age. If you are thirteen (13) years of age but under eighteen (18) years of age, you may use the Service, but only where you have a parent’s consent. Monetize Mobile™ has designed this Privacy Policy in order to comply with the Children’s Privacy Protection Act (“COPPA”).

How Will We Use Your Information?

We use the personal and other information we collect (i) to provide you with the products and services you order; (ii) to notify you about new features and services on the Service or other products and services that we think you will find interesting; and (iii) for analytical purposes to help us to improve the Service and for our business generally.

Will We Share Your Information With Third Parties?

By submitting your Personally Identifiable Information to Monetize Mobile™, you expressly grant us the right, subject to applicable state and federal laws and regulations, to use that Personally Identifiable Information for marketing purposes. We may share, rent, lease, and/or otherwise distribute any and all Personally Identifiable Information with or to any third party for any and all uses permitted by this Privacy Policy and applicable laws and regulations. These third parties may include providers of the products and/or services that you requested by and through our Services, providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation, email marketers, telemarketers, and direct marketers.

We may also share your Personally Identifiable Information with third party contractors, billing companies, cell phone carriers, and our third party customer care call center to facilitate billing, to process credits and refunds, for customer service, and to communicate with you via text message. The third party contractors agree to use the Personally Identifiable Information only to perform the service for us. We may supplement the information we collect from you with outside records in order to enhance our ability to serve you.

Ads that appear on the Service may be delivered to users by a number of participating third party providers that may change from time to time. Information about users' visits to the Service, such as the number of times they have viewed an ad (but not user name, address, or other Personally Identifiable Information), may be used to serve ads to users on the Service.

We may disclose Personally Identifiable Information as required by law and/or to comply with a judicial proceeding, court order, or legal process. We may also disclose Personally Identifiable Information: (i) when we believe that disclosure is necessary to protect our rights; (ii) to protect the rights, safety or property of our users, of Monetize Mobile™, or third parties; (iii) if we believe that you have violated this Privacy Policy or the Terms of Service, or (iv) if we believe such disclosure will prevent a crime from occurring. We may also transfer Personally Identifiable Information if we go through a business transition such as a merger, consolidation, acquisition by another company, or sale of all or a substantial portion of our assets.

We compile aggregated demographic information about our users to enhance our Service and meet our customer’s needs. We may also share aggregated data about our users, including the number of users that we have. Except as noted above, we do not link aggregate user data with Personally Identifiable Information.

We reserve the right to share your Personally Identifiable Information with third parties for promotional purposes as described above. By submitting your Personally Identifiable Information, you agree that such act constitutes a purchase, an inquiry and/or an application for purposes of the Amended Telemarketing Sales Rule, 16 CFR §310 et seq. (the “ATSR”) and you agree to receive marketing from us and/or our third party advertisers. Even if your telephone number is listed on the Federal Trade Commission’s Do-Not-Call List, we retain the right to contact you via telemarketing in accordance with the ATSR. Moreover, if you register or make a purchase or request information from a third party seller at or through websites owned and/or operated by Monetize Mobile™, or websites providing our Service, this will also constitute a purchase, an inquiry and/or an application with the respective third party seller for purposes of the ATSR and you may be contacted via email, direct mail and/or telephone by that third party seller in accordance with the ATSR. We also retain the right to contact you via text-message based marketing in accordance with applicable state and federal law even if your mobile telephone number is listed on state and/or federal Do-Not-Call registries. Further, you agree that we reserve the right to share, sell, rent, lease and/or otherwise distribute your mobile telephone number and other mobile data with/to any third-party for any and all non-marketing uses permitted by this Privacy Policy and applicable law.

By agreeing to this Privacy Policy, you hereby consent to disclosure of any record or communication to any third party when we, in our sole discretion, determine the disclosure to be appropriate including, without limitation, sharing your email address with other third parties for suppression purposes in compliance with the requirements of the CAN-SPAM Act of 2003, as amended from time-to-time.

Change or Removal of Your Personally Identifiable Information, Privacy Preferences, and Opting Out

At your request, Monetize Mobile™ we will remove Personally Identifiable Information that you have provided to us by emailing us at privacy@monetizemobile.com. Please note that deleting your Personally Identifiable Information or otherwise opting-out of receipt of communications from us or third parties will only change or delete the data in our database for purposes of transacting future business and for managing future communications from us and third parties. Such deletions will also not change or delete Personally Identifiable Information already collected as part of a particular transaction in our database, which may have already been shared with third parties, as provided in this Privacy Policy. You will need to contact third parties who may contact you directly to change your preferences or your Personally Identifiable Information that they may be using to contact you.

We provide users with the option to opt-out from receiving information sent via email and/or text messaging on behalf of third party advertisers. Users may unsubscribe from receiving emails and/or text messaging at any time by following the instructions contained at the end of every email and/or text message, as applicable. If you wish to opt-out of receiving emails and/or text messaging, as applicable, from a particular sender, please consult that sender’s opt-out policies or contact that sender.

Information sent on behalf of third party advertisers may be prepared several days in advance, so users may continue to receive email and/or text messaging from us for up to ten days following the unsubscribe procedures detailed above. If, after that point, a user is still receiving email and/or text messaging from us, the user should contact us at privacy@ monetizemobile.com.

Links to Third Party Sites

We may provide links from the Service to other websites that are not owned or managed by Monetize Mobile™. Please be aware that we are not responsible for the privacy practices of third party websites. This Privacy Policy does not apply to any of the linked third party websites. This Privacy Policy applies only to information collected by us. The third party operator of the website (and not us) is responsible for the information collection, use and disclosure practices of those third party websites. We strongly encourage you to read the privacy statements of each and every website that you visit.

Security

We take the security of your Personally Identifiable Information seriously and adhere to generally accepted industry standards to protect information submitted to us, both during transmission and upon its receipt. All information collected is stored in a technically and physically secure environment. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot warrant or guarantee the absolute security of any information that you transmit to us, and you do so at your own risk. Your California Privacy Rights

California Civil Code Section 1798.83 permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the Personally Identifiable Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personally Identifiable Information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Your Acceptance of this Privacy Policy

By using the Service, you are agreeing to the terms of this Privacy Policy and the Monetize Mobile™ Terms of Service. Any dispute as to the terms of this Privacy Policy will be interpreted and construed in accordance with the laws of the State of Nevada without reference to its rules of conflicts of law. Venue and jurisdiction for any federal or state court litigation shall be Clark County, Nevada.

We will also communicate with you in response to your inquiries, to provide the Services you request, and to manage your account.
